Ray Flowers, 3015 Stallings Road, Harrisburg, North Carolina 28075 <br />has applied for a Department of the Army (DOA) permit TO RELOCATE A PORTION OF <br />THE CHANNEL OF BACK CREEK TO REDUCE FLOODING OF RESIDENTIAL PROPERTY OFF <br />STALLINGS ROAD SOUTHEAST OF HARRISBURG, CABARRUS COUNTY, NORTH CAROLINA. <br /> <br /> The following description of the work is taken from data provided by the <br />applicant and from observations made during an onsite visit by a <br />representative of the Corps of Engineers. Plans submitted with the <br />application show the proposed relocation of approximately 250 feet of the <br />existing channel of Back Creek. The proposed channel would be approximately <br />190 feet long and located from 60 to 80 feet southeast of the existing <br />channel. The proposed channel would have a bottom width of 22 feet, a depth <br />of 7 feet and side slopes of 2:1 which would be similar to the cross section <br />of the existing channel. A total of approximately 1,440 cubic yards of <br />material would be eMcavated by backhoe to construct the proposed channel. The <br />majority of this mateCial would spread over adjacent pasture land; however, <br />approximately 195 cubic yards would be stockpiled on the natural levee for <br />later discharge into the existing channel to form two 30-foot-wide plugs. The <br />plugs would be constructed to close off the existing channel following <br />stabilization of the proposed channel and would be armored with rock to <br />prevent erosion. The purpose of the work is to remove a stream channel <br />meander and reduce flooding on adjacent residential property. Plans showing <br />the work are included with this public notice. <br /> <br /> The State of North Carolina will review this public notice to determine <br />the need for the applicant to obtain any required State authorization. No DOA <br />permit will be issued until the coordinated State viewpoint on the proposal <br />has been received and reviewed by this agency, nor will a DOA permit be issued <br />until the North Carolina Division of Environmental Management (DEM) has <br />determined the applicability of a Water Quality Certificate as required by PL <br />92-500. <br /> <br /> This application is being considered pursuant to Section 404(b) of the <br />Glean Water Act (33 U.S.G. 1344). Any person may request, in writing within <br />the comment period specified in the notice, that a public hearing bo held to <br />consider this application. Requests for public hearing shall state, with <br />particularity, the reasons for holding a public hearing. <br /> <br /> <br />
