STAFF REPORT <br /> <br /> Ret: The River/Stream Overlay Zone (RSOZ) Text Amendment, <br /> Coddle Creek Reservoir Mitigation Plan <br /> <br /> Date: June 13, 1990 <br /> <br /> In early May, the Planning and Zoning Department wes asked <br /> to see if there was any way in which the county's zoning <br /> regulations could be emended so as to help out on a then <br /> r~jected counly mitigation plan for the Coddle Creek <br /> Reservoir. Essentially what had happened wes the critical <br /> permit required by the ~ederal Government, entitled e <br /> Section 404 Pe~mit, wes goir~9 to be denied because the <br /> County was destroying wetlands to create a water supply <br /> reservoir. Having unsuccessfully proposed a variety of <br /> mitigation ptans, the suggested option was that either the <br /> reservoir project would be denied or the County would have <br /> to buy a separate piece of land, in the neighborhood of 200 <br /> to 250 acres, and create a wetland. <br /> <br /> After several phone cells, meet ings~ and a review of <br /> literature a draft text amendment was sent to the <br />· -. coordinating Federal Agency, the United States Army Corps of <br /> Engineers. This proposal caught the Corps by surprise as the <br /> concept had never been considered or used by any other <br /> permit applicant. Through a series of revisions, e text <br /> became verbally accepted by the Corps. As the permit is <br /> multi-depar tmental, the new text was then circulated to <br /> other Federat Agencies. <br /> <br /> The et tached text amendment proposal reflects the latest and <br /> expected final version et the wetland protection <br /> regulations. Additionally, a copy of the latest <br /> correspondence has been included for your review to help you <br /> understand some et the complexity of the issue. We ere <br /> presenting the text addition to the Planning Board for your <br /> approval so that the Corps of Engineers will issue a <br /> t~voreb{e report end approve the permit. We have been <br /> informed that until the amendment is acted on~ the permit. <br /> will not be ~ssued. Likewise, we believe the amendment is <br /> proper in promoting sound planning practices in the County <br /> and sensitive to our ecosystem. <br /> <br /> A more detailed report can be given at the Planning Board <br /> meeting. <br /> <br /> <br />
