The County is not required to have a franchise for the <br /> operation of the Cabarrus County Emergency Medical Service <br /> System, including both emergency and non-emergency ambulance <br /> services. The County is required, however, to meet all the <br /> standards established by this ordinance for the operation of such <br /> services. <br /> <br /> The ambulance operating authority previously 9ranted to <br /> Charlotte Motor Speedway, Inc., shall be deemed to be a franchise <br /> for Emergency Ambulance Service and shall remain in full.force <br /> and effect provided, however, said franchisee is required to meet <br /> all the standards established by this ordinance for the operation <br /> of such services. <br /> <br /> SECTION 16. VIOLATIONS: <br /> <br /> Any ambulance provider charging in excess of the rates <br />authorized by the County, pursuant to this ordinance, shall be <br />subject to a civil penalty of Fifty Dollars ($50.00) for each <br />violation. <br /> <br /> Any violation of the provisions of this ordinance shall be a <br />misdemeanor punishable by a fine not to exceed Fifty Dollars <br />($50.00) or imprisonment not to exceed thirty (30) days. <br /> <br /> Each day that any violation of, or failure to comply with, <br />this ordinance is committed or permitted to continue shall <br />constitute a separate and distinct offense under this section and <br />shall be punishable as such hereunder. Each ambulance run <br />unlawfully performed shall be considered a separate offense. <br />Each incident of willful falsification of data by a franchisee <br />shall be considered a separate offense. <br /> <br /> The County Manager may, if he or she shall find that any <br />person, firm or entity is operating an ambulance in Cabarrus <br />County in violation of the provisions of this ordinance, and <br />after notice to such person, firm or entity of any such <br />violation, apply to the Superior Court for a temporary and/or <br />permanent restraining order or injunction to restrain such <br />person, firm or entity from continuing such illegal practice. If <br />upon such application, it shall appear to the Court that such <br />person, firm or entity has violated or is violating the <br />provisions of this ordinance, the Court may issue the requested <br />injunctive relief. Injunctive relief as provided herein may be <br />granted regardless of whether criminal prosecution has been or <br />may be instituted under the provisions of this ordinance. <br /> <br /> <br />
