PAG~ 4 OF <br /> <br /> 13. Officlals Not to Benefit. No me~ber of or delegate to the Congress <br /> for the United States of A~erica, resident commissioner or employee of <br /> the United States Government, shall be entitled to any share or part <br /> of this contract or any benefits to arise herefrom. <br /> <br />16. Equal Employment Opportunity. <br /> (a) The Center shall not discriminate against any employee applicant <br /> for employment or subcbntractor because of race, color, handicap, <br /> religion, age, sex or national orlBin. The Center shall take <br /> affirmative action to insure that applicants are employed and <br /> subcontractors (subcontractors must be mutually approved) are selected, <br /> and that employees are treated equally during employment, ~ichouc <br /> regard to their race, color, handicap, religion, abe, sag or national <br /> origin, Such action shall include, but not be limited to the <br /> following: employment, upgrading, demotions or transfers; recruitment <br /> recruitment advertising; layoffs or terminations; rates of pay or <br /> other forms of compensation; selection for training including <br /> apprenticeship; and participation in recreational and educational <br /> activities. The Center certifies that it presently has in effect such <br /> an affiramtive action program. The Center agrees to post in a <br /> conspicious place available to employees and applicants for <br /> employment, notices setting forth the provisions of this non- <br /> discrimination clause. The Center shall in all solicitations or <br /> advertisements for subcontractors or employees placed ~y or on <br /> behalf of the Cerrer sr~t~ that the Center is an "Equal Opportunity <br /> Employer". (b) The Center shall keep such records and subait such <br /> reports concerning characteristics of applicants for employment and <br /> employees as the Council and the North Carolina Oivison of Aging <br /> require. (c) The Center agrees to comply ~ith such guidelines as the <br /> Purchaser or the North Carolina Division of tgi~g may issue to <br /> implement the require;ants of this paragraph. (d) The Center agrees <br /> to co~pl), ~ith Title VI and Title ¥II of the Civil Rights Act and <br /> Section 506 of the Rehabilitation Act. <br /> <br />15. Inde;nity and Insurance. The Center agrees to indemnify and save <br /> harmless the Purchaser, its agents and employees ~rom and against any <br /> and ail loss~ cost; da=ages, expense and liability caused by the <br /> failure of the Center to £ully perform its obligations under this <br /> agreement and in accord ~ith its ter~s; or by an accident or other <br /> occurrence causing bodily injury, including death~ sickness and disease <br /> to any person; or damage or destruction to property, real or personal, <br /> ~hich any arise fro~ operations, products or services rendered under <br /> this contract. <br /> <br />1Sa. Indemnity'and Insurance. Purchaser agrees to indemnify and save <br /> harmless the Center, its agents and employees from and against any and <br /> all loss, cost, damages, expense and liability caused by the failure <br /> o6 the ~urchaser to fully perform its obligations under this <br /> agreement and in accord ~ith its terms; or by an accident or other <br /> <br /> <br />
