March 13, 1989' <br /> <br />Cabarrus County Commissioners <br />Concord, <br />North Carolina 28025 <br /> <br /> The undersigned DOGWOOD PARTNERS I do hereby agree that they <br />will withhold their intended action of having their subdivision <br />plat for DOGWOOD finally approved until such time as a center <br />line for the Westside Bypass is determined. The undersigned David B. <br />Austin and William S. Austin ("Austin") further agree that if <br />a fifth alternate route of the Westside Bypass is chosen which <br />would allow the Dogwood project and the Westside Bypass to coexist <br />and which is acceptable to Dogwood Partners I, Austin will make <br />a donation of property to the North Carolina Department of Trans- <br />portation over portions of land that the fifth alternative would <br />travel. Said donations would include any land that is owned by <br />Austin or Austin and others over which the right-of-way of the <br />fifth alternate route would travel. <br /> <br /> <br />
