SENATE BILL 111: SOLID wAsTE LAW REVISIONS <br /> <br /> Preliminary Section-by-Section Summary <br /> <br />Introduction <br /> <br />Senate Bill 111 represents a significant change in state policy on <br />solid waste management. The new law provides definite direction for <br />change in the local administration of solid waste collection, <br />management and disposal. Many of the features of SB 111 reflect <br />pending Federal directives which are expected to become effective in <br />early 1990. <br /> <br />Section 1: Definitions <br /> <br />Several important new definitions were added to Chapter 130A of the <br />General Statutes. These include: <br /> <br /> "Closure" of solid waste facilities to assure that these pose no <br /> significant threat to human health or the environment. <br /> <br /> "Construction and Demolition" waste and debris. <br /> <br /> "Designated Local Government" meaning those units which hold <br /> permits to operate solid waste management facilities. <br /> <br /> "Inert Debris" covering wastes which retain physical and chemical <br /> structure after disposal. <br /> <br /> "Land Clearing Debris" generated solely by land clearing <br /> activity. <br /> <br /> "Medical Waste" covering non-hazardous medical wastes. <br /> <br /> "recyclable Material" covering those materials which can be <br /> recovered, reprocessed and reused. <br /> <br />- "Special Wastes" meaning solid wastes requiring special handling <br /> <br /> · -(e.g.: used oil, lead-acid batteries, medical wastes, white <br /> goods, and whole tires) <br /> <br />Section 2: Solid Waste Management Act of 1989 <br /> <br />This is the most important section of the new law. It mandates new <br />responsibilities for state agencies, local governments, and the <br />private sector as follows: <br /> <br /> Findings and Purpose (130A-309.03) <br /> <br />- Current solid waste management practices are inadequate and <br /> wasteful. <br /> <br />- The state has a role in assisting local governments in improving <br /> methods and processes. <br /> <br /> -OVER- <br /> <br /> <br />
