Box 707
Concord NC 28025

Dear Board of'Cc~missioners:

This letter is to request a waiver of any late listing penalties that may be
assessed against our business for late filing of our 1989 Business Personal
Property listings.

On June 17, 1988, I called the cabarrus County Assessor's ~ffice and spoke with
Mr. Danny Seamone concerning the 1989 Business P~operty Listing. Mr. Seamone
explained that their system did not allow them to set up new businesses before
December and that we wguld be set up in December 1988. Our Tons O' Toys store
~opened in September 1988. We opened four (4) stores in 1988 and T made all the
necessary arrangements with the proper taxing authorities for each store before
any of the new stores were opened.

Our store in Cabarrus County was the only store for' which we did not receive a
1989 Business Personal Property Listing. Apparently, Mr. Seamone did not set
us up in December. :

On June 6, 1989, Mr. Seamone arrived at our Tons O' Toys store in Cloverleaf
Plaza and told our store manager that a B6siness Personal Property Listing had
not been filed.

On June 14, 1989, I called the Cabarrus County Assessor's Office and asked to
speak with Mr. Searr~ne. I was told that he was out, therefore, I talked to his
assistant who kindly explsined to me that although Cabarrus County did not send
us a Bttsiness Personal Property Listing, we would still hav~ to pay the late fee
since the Assessor's Office did not have the authority to waive the fee.

We have seventeen Stores in four states and we certainly strive to comply with
all of the laws and regulation~ in the conn~U-Lities in which we operate. We also
strive to take care of any obl.igations and listing information as soon as we are
