CABARRUS COUNTY <br /> Post Office Bo~ 707 <br /> CONCORD, NORTH CAROLINA 28025 <br /> <br />December 16i 1987 <br /> <br />To: Mr. Charles McGinnis <br /> <br />From: Walter Odell ~)80 <br /> <br />Subject: County Jail Addition <br /> <br />Per your instructions, I contacted Mr. Jake Wicker <br />at the North Carolina Institute for Government concerning <br />the ability of local goverernmental departments <br />undertaking large capital improvements projects. <br /> <br />Mr. Wicker informed me that the North Carolina <br />Statutes set a cap of $75,000 for projects under- <br />taken through forced account financing. <br /> <br />He suggested that any action other than securing contracts <br />through the competative bidding process is not <br />addressed in the general statutes but could be under- <br />taked if so allowed by local board action in the <br />form of a resolution. He also suggested that a <br />resolution clearly state the nature of the project <br />and all previous attempts to secure contractors. <br /> <br />Mr. Wicker stated that he personly would advise <br />further attempts to negotiate a contract based <br />on a fixed fee determined by the architect as to <br />the value of the work plus a percentage profit <br />for the contractor. He also felt that it would be <br />necessary ko adopt a special resolution to cover <br />this type of action. <br /> <br />Lastly, Mr. Wicker recommended that any action taken <br />be endorsed by the General Assembly during the short <br />session even if it is after the fact as additional <br />protection to the Board. <br /> <br /> <br />
