Article III Remedies For Non-compliance 1)' The County agrees to reimburse the city for the costs of damages to treatment works or disruption of treatment processes or operations including eosts for sludge disposal that may result from any unauthorized wastewater discharge. 2) It is agreed that the County may impose fines upon the responsible parties for unauthorized or unpermitted eonnentions to the County's collection system and the City may impose fines upon the responsible parties for unauthorized or unpermitted discharge of wastewater for treatment is the Rocky River Regional Wastewater Treatment System. 3) The City and the County agree to not accept any wastewater from any source, domestic or non-domeatie~ whose faeilities do not meet all state requirements concerning obtaining a permit prior to construction. 4) The County and the City agree to support and to consider binding the enforcement procedures and action taken to correct, by timely eomplianoe~ violations of the City's Ordinance and Pretreatment Program~ provided such action and procedures are in accordance with "Section 13-15, Enforcement Procedures", of the City's Ordinance. 5) The County agrees that the City may impose such fines aa deemed appropriate by due process and iH conformance with the City's Sewer Use Ordinance. 6) In the event the County fails to comply with any of the terms of this agreement~ the County and the City agree that the City will not provide additional services for any new connections, domestic or non- domestic; until compliance is achieved or until an acceptable program of compliance has been agreed upon by the board and the County. 7) If disputes occur the County and the City agree to use mediation and the courts as a means to settle differences that can not be resolved otherwise.
