Post Office Box 707
CONCORD, NORTH CAROLINA 28025

December 16, 1987

To: Mr, Charles McGinnis
From: Walter OdellLl)~O
Subject: County Jail Addition

Per your instructions, I contacted Mr. Jake Wicker
at the North Carolina Institute for Government concerning
the ability of local goverernmental departments
undertaking large capital improvements projects.

Mr. Wicker informed me that the North Carolina
Statutes set a cap of $75,000 for projects under-
taken through forced account financing.

He suggested that any action other than securing contracts
through the competative bidding process is not
addressed in the general statutes but could be under-
raked if so allowed by local board action in the
form of a reso~ution. He also suggested that a
resolution clearly state the nature of the project
and all previous attempts to secure contractors.

Mr. Wicker stated that he personly would advise
further attempts to negotiate a contract based
on a fixed fee d~termined by the architect as to
the value of the work plus a percentage profit
for the contractor. He also felt that it would be
necessary to adopt a special resolution to cover
this type of action.

Lastly, Mr. Wicker recommended that any action taken
be endorsed by the General Assembly during the short
session even if it is after the fact as additional
protection to the Board.
