NORTH CAROLINA <br /> PETITION TO CLOSE PUBLIC ROADS/~SEMENTS <br /> CABARRUS COUNTY <br /> <br /> THE UNDERSIGNED does hereby request the Board of Con~issioners of <br /> Cabarrus County to adopt a resolution declaring its intent to close a <br /> public road/easement and, pursuant to N.C.G.S. 153A-241, to call a public <br /> hearing on said question and in support of said petition shows unto the <br /> Board: <br /> <br /> 1. The legal description of the road the petitioner desires to close <br /> is as follows: <br /> <br /> Beginning at an existing icon pin being a co~on corner <br /> of Davis, Tommy Freeman, George C. Blount, etal~ and <br /> 8artsell tracts, all being located in Number TWO Town- <br /> ship, Cabarrus County, North CDrolina; thenge.with a <br /> <br /> 67--26-{~OW. 44.87 feet to an existing iron pin being <br /> situated S.67-26-OOE. 34.54 feet from an existing iron <br /> pin in the eastern Right of Way line of Ivey Cline Road; <br /> thence with the old western Right of Way line of <br /> Sand Clay Road N.28-10-19E. 557.04 feet to a new iron <br /> pin in the western Right of Way line the 1-85 service <br /> ramp; thence S.9-29-09W. 42.79 feet to an existing <br /> iron pin thence with said Right of Way S.7-48-22W. <br /> 88.93 feet to an existing iron pin; thence along the <br /> eastern Right of Way of Sand Clay Road S.28-10-19W. <br /> 428.75 feet to the point and place of beginning and <br /> containing 0.504 acres all of which is lying within <br /> an abandoned 44 foot Right of Way all as shown on a <br /> survey by Jack R. Christian and Associates dated <br /> October 9, 1987. <br /> <br /> 2. The petitioner requests that said Roads/Easements, as shown <br /> <br />on the above-referenced Plat, which have not been used by the public <br />since Interstate 85 opened more than 20 years ago, be closed to the <br />public. <br /> <br /> 3. The petitioner is an adjoining property owner to said <br />Roads/Easements; that no individual or entity owning property in the <br />vicinity of Roads/Easements or in the subdivision in which they are <br />located will be deprived of a reasonable means of ingress and egress; <br /> <br /> <br />
