4. RELEASE OF LIABILITY: Lessee agrees to hold Lessor <br />completely blameless from any and all liability which may arise <br />due to Lessee's use of the leased properties. Lessee assumes full <br />responsibility for any and all liability which may arise as a <br />result of using the said premises for the intended purpose as <br />stated herein. <br /> <br /> 5. OPTION BY LESSEE TO TERMINATE LEASE: If Lessee has paid <br />all installments of rental theretofore due and has done and <br />performed all matters and things herein specified to be done and <br />performed by it, it may terminate this lease by giving to the <br />Lessor thirty (30) days written notice of its intention to do so <br />and paying to Lessor an additional amount equal to one (1) month's <br />rent of the premises. Lessee may terminate at any time without <br />penalty should it be unable to fly the paraplane over the leased <br />premises or landfill due to any type of governmental action. <br /> <br /> 6. BANKRUPTCY OR INSOLVENCY OF LESSEE~ It is expressly <br />agreed that if, at any time during the term of this lease, Lessee <br />should be adjudged bankrupt or insolvent by any federal or state <br />court of competent jurisdiction, LesSor may at its option, declare <br />this lease terminated and cancelled and take possession of the <br />said premises. <br /> <br /> 7, ASSIGNMENT AND SUBLE~fING: Lessee shall have the right to <br />sublet or assign all or any portion of the demised premises for a <br />use substantially similar to the use to which Lessor has leased <br />the entire premises bug shall not have the right to sublet or <br />assign the lease for any other purpose without the written consent <br />of Lessor. <br /> <br /> 8. FORFEITURE FOR NON-COMPLIANCE: It is expressly agreed <br />that if any monthly installment of rent as herein called for shall <br />remain overdue and unpaid for forty-five (45) days, Lessor may at <br />its option at any time after such default declare this lease <br />terminated and oancelled and take possession of said premises. <br /> <br /> <br />
