CABARRUS COUNTY
Poet Office Box 707
CONCORD, NORTH CAROLINA 28026

March 24~ '1988

MEMO
TO= Charles McGinnls
FROM: Blair Bennett
SUBJECT: Risk Managemeat Research

I have researched our current risk management study, and
contacted our current Insurance carriers to address the
problem relating to the use of County facilities by private
or non-profit organizations.

Our insurance carrier for general liability, Fred S. James
Co., advised me that non-county employees, such as
voluateere, would nat be covered tar any act ia which
damage to another persons property occurred. An example
of this would be if a volunteer was washing a car and
In some way damaged that vehicle. Other coneiderations
pointed out by the carrier related to the exposure when
preparing meals and serving them to the public for a fee.
If some type of food poisoning developed, the County could
be liable.

I have been advised that coverage for this type of liability
would be cost prohibitive f~r a non-profit group to attain.
If the County were to decide to take this type of risk,
hold harmless agreements with tho organizations should be
provided, as well as certificates for general liability
insurance in the amount of $1,000,000.00. Consideration
should ~lso be given for maintenance~ utilities, heating,
and air 'conditioning needed to provide this facility.

mf
