SECTION 3.3 ABBREVIATED PROCEDURE FOR MINeR SUBDIVIRIONR <br /> <br /> If the Planning Department finds that the sketch plat meets <br /> the requirements Of a minor subdivision-es defined by this <br /> ordinance and that there ere no adverse affects on the <br /> remainder of the parcel or on adjoining property, then the <br /> subdivider may p¥oceed with the preparation of a final plat <br /> pursuant to Section 3.5. Plate for minor subdivisions may <br /> be given final approval by the Planning Director. However, <br /> if the subdivider owns, leases, holds an option, or holds <br /> any legal or equitable interest In any property adjacent to <br /> or located directly across a street, easement, road or <br /> right-of-way from tho property to be subdivided, the <br /> subdivision shall not qualify under the abbreviated <br /> procedure. <br /> <br /> Furthermore, the abbreviated procedure may not be used a <br /> second time within three (3) years on any property less than <br /> fifteen hundred (1500) feet from the original property <br /> boundaries by anyone who owned, had an option on, or any <br /> legal interest in the original subdivision st the time tho <br /> subdivision received preliminary or final plat approval. <br /> <br />SECTION 3.4 PRELIMINARY PL~.~. REQUIREMENTR <br /> <br />A. GENERAL.--:The subdivider: shall-submit Seven (7) copies <br />of a preliminary plat. The copies must be received by the <br />Planning. Department at least fourteen (14) days prior:to the <br />regularly*scheduled meeting of t.he Planning Board. <br /> <br />B. REVIEW:--The-Planning: Boardc-shall*act on-the*-- submitted <br />subdivl:sion-plat within thirty-five (3S) dsyJ-of-the'meeting <br />for which such plat is scheduled for review.- If necessary, <br />modifications of.the preliminary plat may bo required by tho <br />Planning Board as conditions of preliminary approval. The <br />modified preliminary plat will then bo resubmitted according <br />to tho procedure set forth in Section 3.4A. The Planning <br />Board may express its approval and state the conditions of <br />such approval, if any, or if disapproved shall express its <br />reason thereof. <br /> <br />If the. Planning Board fails to act within the above specified <br />thirty-five (35) days the subdivider may seek preliminary <br />approval at the next regular meeting of the Board of <br />Commissioners of Cabarrus County. <br /> <br />C. SPECIFICATIONS FOR PLATS - Unless each lot In a <br />proposed subdivision te more than three (33 acres the <br />preliminary plat shall be drawn at a scale of one hundred <br />(100) foot to the inch.
