Board of County Com/nissioners of Cabarrus County <br />Cabarrus County Zoning Administrator <br />Cabarrus County Planner <br />Cabarrus County Attorney <br />Page 2 <br />March 10, 1987 <br /> <br />The City Council then unanimously voted to conduct a public hearing on <br />the question of reclassify%ng this particular segment of property and <br />to take such steps as were necessary to make the change. <br /> <br /> At the City Council meeting held March 9, 1987, the City Council <br />held a public hearing on the question of changing the Kannapolis long- <br />range land use plan so as to designate the property in question, and <br />in particular the glass company property, commercial instead of <br />residential. No one spoke in opposition to the suggested change. There <br />were a number of persons, including neighboring property owners, who <br />appeared to speak in favor of changing the classification to commercial. <br />Following the public hearing, a motion was made to change the classifi- <br />cation of the properties, including the property of Kannapolis Glass and <br />Glazing, Inc., from residential to commercial. This motion was <br />unanimously adopted. <br /> <br /> It is my opinion that had City Council had the full information <br />concerning the properties at the time it initially adopted the land use <br />plan, the recommendation of the Kannapolis Planning Board that this <br />property be classified as commercial would have been followed and the <br />action which changed it to residential would not have been taken. The <br />actions set forth above were taken when the City Council realized its <br />error in changing the recommendation of the Planning Board. <br /> <br /> It is also my opinion that when the zoning ordinance for the City <br />of KaDnapolis is adopted and the zoning atlases approved, the section <br />of property lying south of Dakota Street between South Ridge Avenue and <br />the Southern Railroad will be classified as commercial properties. <br /> <br /> I hope that the above information will assist you in determining <br /> appropriate actions'that should be taken. <br /> <br /> Bachman S.
