Pilkington, Health Director <br /> Cabarrus County Health Department <br /> Post Office Box 1149 <br /> Concord, North Carolina 28025 <br /> <br /> RE: Amendment to Permit //13-02, Cabarrus County Sanitary Landfill <br /> <br /> Dear Mr. Pilkington: <br /> <br /> ~he Branch has reviewed the various proposals for revision of the amended <br /> permit for the referenced site and has reached the following conclusions: <br /> <br /> the proposed stockpile area is approved on the condition that the disturbed <br /> area be kept as small and as far from the property boundary as reasonably <br /> possible. <br /> <br /> ~he Branch does not encourage, the sale of any landfill property which would <br /> reduce the buffer area; however, there are no regulations which would prevent <br /> this particular transaction. Access to the sediment basin must be maintained <br /> by whatever means possible. A new deed description must be provided which <br /> would include the newly acquired property and eXClude the sold property. <br /> Rhese changes would be incorporated into the revised permit. It should be <br /> noted that the new property will be pe~nnitted as a buffer area only and must <br /> be reviewed at a later date if proposed for disposal purposes. <br /> <br /> ~he Branch has serious concerns about the development and operation of the <br /> referenced site. An orderly progression with a phased construction plan which <br /> restricts the disturbed and active disposal area into the smallest area <br /> feasible must be developed and implemented. A meeting with our field <br /> personnel, the consultants, and the county must be scheduled as soon as <br /> possible to address these concerns. <br /> <br /> As stated in a previous letter dated November 13, 1987, the county must <br /> fulfill the conditions of the amended permit by January 1, 1988, or the permit <br /> will not become effective. <br /> <br /> <br />
