B. Transfer and Abandonment 1. No franchise Shall be transferred or abandoned by a holder'without at least 30 days prior written notice to the Health Department and prior approval by the County Commissioners. C. The franchise areas described in Appendix A, which is attached hereto and made a part hereof, being the franchise areas presently assigned to the persons named therein, are hereby deemed to be effective, unless terminated as provided herein. New or renewal franchises shall be awarded for terms not exceeding five (5) years. D. Termination and Suspension - All or any portion of a fran- chise may be terminated or suspended for any of the follow- ing reasons by the procedures provided in Article XV hereof: 1o Failure to pass the annual inspection of facilities, equipment, and operating methods; 2. Non-compliance with or violation of the maximum fee schedule promulgated by the County Co~m~issioners; 3. The attempted transfer of a franchise without prior written approval of the County Con~issioners; 4. Collection of refuse or the solicitation of customers outside the territorial area awarded to the holder of the franchise; 5. Failure to comply with the terms and provisions of this ordinance or regulations promulgated by the County Commissioners or the Health Department hereunder; 6. Failure to render regular service at least once during each seven-day collection period for reasons other than those specified in Section VIII; 7. Failure to comply with any directives issued by the Health Director or the County Commissioners after notice of hearing when such directive involves perfor- mance, customer service or compliance with these regulations. E. Any conflict over the grant of a franchise and disagree- ments over franchise territory shall be determined by the County Commissioner~. -7-
