C-4(PDO) REZONING REPORT <br /> PETITION 86-28 <br /> <br />Back,round <br /> <br />On August 1'1, 1986, Ms. Bessie B. Almond filed a petition to rezone a 75 foot <br />by 200 foot lot from C-5 Highway Service District to C-4 Hi§hway Business District <br />with a Planned Development Overlay. The applicant's stated purpose for this <br />rezoning change is to permit a used car sales lot. The POD provision is sought <br />to allow restriction of use to alleviate neighborhood concerns that other non- <br />desirable uses might arise at a later date if a straight C-4 rezoning were <br />sought and approved. <br /> <br />Review <br /> <br />Section 3.9-6(4) of the Cabarrus County Zoning Ordinance requires that the County <br />Planning Director review the proposed PDO in five areas and then make a recommenda- <br />tion for approval or denial. For <br /> this reason either a C-2, C-q or C-5 Zoning Designation is <br /> suitable and appropriate for this intersection. To avoid spot <br /> zoning the entire commercial zone should be zoned uniformly under <br /> one of these classifications. Both the C-2 and C-4 classification <br /> will accommodate the desired use. <br /> <br /> (2) Relation to Major Road~ Utilities and Other Services. <br /> <br /> The applicant's property fronts on a ma~or thoroughfare and has <br /> access to county water. Low density development can be accommodated <br /> With on site sewage disposal. <br /> <br /> (3) Evidence of Unified Control. <br /> <br /> No special features or improvements are planned as part of this <br /> POD. Therefore, existing zoning control is sufficient to control <br /> planned PDO provisions. <br /> <br /> <br />
