'o- · Page 2 <br /> <br /> The bailiff supervisor ~ill position hi'self at the end of the clerk's table <br /> <br /> where he will open and close court, call witnesses or defendants as directed by <br /> the Judge and pass court documents from t~e District Attorney to the clerk's table. <br /> %*he bailiff supervisor will maintain order in the courtroom and protect court <br /> personnel from any acts of violence. He ~ill further carry out orders of the court <br /> in compliance %rith this directive. Ha will not be utilized as an errand boy to <br /> bring coffee to the court personnel, leave the courtroom to locate attorneys, nor <br /> ~ill he be required to take custody of any evidence that is turned into the court. <br /> The bailiff supervisor's responsibilities are important in nature and limited in <br /> scope t~ those areas delineated in .this directive. <br /> <br /> As cases are called requiring the presence of defendants incarcerated, the <br /> bailiff supervisor will geed the bailiff assistant to bring the defendant into <br /> the courtroom in as timely a manner as possible without risk of escape. At no <br /> time will more than two (2) Jailed defendants be brought into the courtroom at a <br /> time from the jail. As they are brought in, they will he taken to the jurybox <br /> and seated until their case is called. While any incarcerated defendants are in <br /> the courtroom, the bailiff supervisor and the bailiff assistant ~ill both be in <br /> the courtroom at all times. The bailiff assistant will position himself at the <br /> <br /> opening of the jurybox to maintain custody of the defendants. . . <br /> <br /> When defendants not incarcerated are tried and incarcerated, or ordered to <br /> pay a fine or costs~ they are to be placed in the Jurybox until such time as the <br /> bailiff assistant has time to take them to the clerk's office or to the Jail as <br /> the case may dictate. It will be permissible to leave defendants who were not <br /> already incarcerated waiting to pay a fine in the jurybox while the bailiff assistant <br /> takes a jailed defendant to the Jail. According to Chief District Judge R. L. Warren, <br /> a defendant is in custody, whether stated or.not until he bas satisfied the court %rlth <br /> payment of any imposed fine. Defendants placed on supervised probation will not be <br /> in custody. They will pay their fines, etc. through schedules set by the probation <br /> officer.. The bailiff assistant should inquire of each defendant in custody whether <br /> he is prepared to immediately comply with payment, and if he is not, then this should <br /> be brought to the Judge's attention before the defendant is taken from the courtroom <br /> so that further orders can be issued to tbe clerk. The clerk in the courtroom will <br /> prepare a bill of costs and give it to the bailiff to be taken with the defendant ~o <br /> thc clerk's office. This must be received by the bailiff prior to taking the defendant <br /> to the clerk's office, Just as it is necessary to receive a commitment order prior to <br /> a defendant being taken to the jail. <br /> <br /> <br />
