abarrus County
heriff's Department
Robed M. Canada¥, Sheriff

TO: All Personnel

FROM: Robert M. Canadsy, Sheriff

EFFECTIVE DATE: October 1, 1985

SUBJECT: Court Bailiff Duties - District Court

Due to changes in the Clerk of Court policie~ it has become necessary

for the Sheriff's Department to adjust our court bailiff procedures. The
Clerk's courtroom personnel will no longer be taking payments of fines and
costs in the courtroom. It is necessary for a bailiff to take the defendaot
do~nlstairs to the Clerk's Office for the pa~mant of the fines.

In that these changes will be new to all of us, we may have to adjust

our procedures more after we see how things go for a while. I have met ~rith
Chief District Court Judge R. ~. Warren and he has assured me that all the
District Court Judges will require the same procedures from the bailiffs,
therefore~ decreasin§ a lot of confusion on the part of our officers.

The Sheriff and his deputies are officers of the court and ~rill make

every effort to follow the instrucions of the Judge presiding over the court.
The officers %.ill at all times be courteous to the Judge and attentive to all
instructions issued by him. We are there to serve the court only and not the
defendants, clerks, or attorneys. Our service to the court will be at all
times in conformity'~;ith issued Sheriff's Department guidelines which have been
developed in consultation with the Chief District Court Judge.

We will have assigned to the District Court, one bailiff who will manage

the operation of other officers serving as assistant bailiffs. This bailiff
will remain in the courtroom at all times that the Judge is on the bench (except
in emergency situations). Any other officer assigned to bailiff duty will shuttle
prisoners from the jail to court or from court to the Clerk's office for payment
of fines and costs.
