SECTION 5. Each fire department desiring to qualify for the financial assistance under this resolution shall meet the following minimum standards: (a) The fire department shall be incorporated aa a nonprofit corporation under the General Statutes of North Carolina. A copy of the department's charter and current bylaws shall be on file in the fire marshal's office. Elections of at least a portion of the board of directors for the incorporated fire depgrtment shall be held at least every year ~y the voting membership of the corporation. The voting membership must include but is not limited to either (1) residents of the fire tax district which have registered with the Cabarrus County Board of Elections and are elig~le to vote in a general election, or (2) all resident property owners of the district. No ~bseetee or prox~ votes will be allowed. Notice of au aunual m~eting to elect officers-shall be given by notice in local newspapers and as prescribed in the department's bylaws. OR Be a fire department lawfully established by a city, town, or sanitary district and operate under the laws and provisions governing such departments[ (b) Each fire department shall have a fire chief, an assistant chief, other necessary officers and personnel ~ith a minimum of nineteen (19) fire fighters who ar~"eligible firemen" in accordance with 1!8-23.- I list of all members, their addresses, their telephone numbers, and social security numbers must be given to the fire marshal on or before July 1 of each year and within 10 days of the addition of new members. (c) All active members of a fire department in good standing shall have some identification, such as a card, badge or car plate to identify them as a "bona fide fire fighter". No one uther than an active member in good standing shall be allowed to have this identification in his possession.
