NORTH CAROLINA <br /> AFFIDAVIT <br />CABARRUS coUNTY <br /> <br /> R. M. FAGGART, JR., PRESIDENT OF SOUTHERN HO~ES, INC., first being <br /> <br />duly sworn, deposes and says: <br /> <br /> 1. That Southern Homes, Inc., is the petitioner who filed a petition <br />with the Board of County Commissioners for Cabarrns County, North Carolina, <br />seeking to close off a segment of Barcliff Road. <br /> <br /> ~. That in accordance with the provisions of North Carolina General <br />Statutes Chapter 155A, Section 241, he has performed the following: <br /> <br /> (a) Caused to be published in the Concord Tribune for four <br /> successive weeks before this hearing a copy of the resolution <br /> of intent wbich was adopted by the Cabarrus County Board of <br /> Commissioners relative to the closing of the street. Tbe <br /> publisher's Affidavit of publication is attached to this <br /> Affidavit as Exhibit A. <br /> <br /> (b) That petitioners o~ all property contingent to Barcliff <br /> Road. <br /> <br /> (c) Caused to be posted at each end of the segment of road <br /> to be closed a notice of closing and of the public hearing. <br /> <br /> {d) Pcsted a copy of the notice of closing and public hearing <br /> at the Courthouse door in Concord, North Carolina. <br /> <br /> 5. That the segment of Barcliff Road which is requested to be closed <br />has never been opened or used in any manner for a street, either public or <br />private, and has not been accepted by the North Carolina Department of Trans- <br />portation as part of its system. <br /> <br /> 4.
