ORDINANCE GOVERNING SURFACE DISCHARGE SEWAGE <br /> TREATMENT PLANTS IN CABARRUS COUNTY, NORTH CAROLINA <br /> <br /> The Board of Commissioners, having considered the necessity of an ordinance <br />regulating the discharg? of wastewater into surface waters of Cabarrus County, <br />North Carolina~ and having found that the adoption of such an ordinance is in <br />the best interest of the general health and welfare of the County does hereby <br />adopt the f~lowlng ordinance pursuant to the authority contained in Chapter 130 <br />and Chapter 130(A) of the North Carelina General Statutes. <br /> <br />Section I - General Cenditimns: <br /> <br />A. No person shall commence the construction or relocation of any residence~ <br /> place of business, or place of public assembly, nor shall any person <br /> locate, relocate or cause to be located or to be relocated any residence <br /> other than one exhibited for sale or stored for the purpose of later sale <br /> on a site in an area not served by a public system of sewage treatment <br /> without first obtaining a discharge permit and an authorization permit <br /> from the North Carolina Department of Natural Resources and Community <br /> Development (NRCD) or an improvements permit from the Cabarrus County <br /> Health Department. Copies of discharge authorization permits shall be <br /> filed with the health department prior to the issuance of a building permit <br /> and shall include the location of the surface discharge system and the <br /> exact location of the point of wastewater discharge. <br /> <br />B. The effluent of all package treatment plants and single-family surface <br /> discharge systems shall be monitored by the Cabarrus County Health <br /> Department for environmental impact on surface waters at a minimum of <br /> once per year. Systems out of compliance with effluent limitations <br /> established with the North Carolina Administrative Code shall be rep®rted <br /> to the North Carolina Department o~ Natural Resources an¢ Community <br /> Development for enforcement action. In addition, these systems shall be <br /> monitored by the Cabarrus County Health Department at least twice within <br /> a six month period after the deadline imposed for compliance by the I~epart- <br /> ment of Natural Resources and Community Development to assure that cempliance <br /> has been obtained. If, at either of these two monitoring inspectiens, <br /> the system is found to be out o~ compliance with tha applicable requirements <br /> cited above, then the party in violation thereof shall be punished as <br /> provided in General Statutes 130(A)-25. <br /> <br />C. A violation of this ordinance shall subject the part in violation to <br /> punishment as provided in G. S. 130(A) of the General Statutes of North <br /> Carolina. <br /> <br /> <br />
