McGinnis/County Manager <br />FROM: Thomas B. Robinson/Planning oirectorl~)~ <br />SUBJECT: Sidestown/Shankletown Sewer Front Footage Charge <br />DATE: April 12, 1984 <br /> <br /> On May 16, 1983, the Board of Commissioners passed an ordinance that levied <br />a $3.50 front foot charge to any property owne~ in the Sidestown/Shankletown <br />Community who applied for a connection to the sewer collection system after <br />that date. <br /> <br /> This action must be rescended for the following reasons: <br /> <br /> 1. The sewer collection system was installed using <br /> a 100% grant from HUD under the Housing and <br /> Community Development Act of 1974~ <br /> <br /> 2. The 1981 Cabarrus County application for those <br /> funds made it clear that no charge would be made <br /> to any property owner. <br /> <br /> 3. Telephone conversations with Tom Ramsay, HUD <br /> Representative, in Greensboro brought out the <br /> fact any charge made by Cabarrus County concerning <br /> this line installed with HUD money is "program income" <br /> and must be returned to the Federal Government. <br /> <br /> 4. Nad HUD known that this action would be taken by the <br /> Commissioners the grant application may not have <br /> been funded. <br /> <br /> 5. This charge will be regarded by HOD, unless it is <br /> rescended, as evidence that Cabarrus County is not <br /> committed to carrying out the intent of the Community <br /> Development Program, and <br /> <br /> 6. Future applications for Federal funding under HUD <br /> may be 'damaged by this action. The competition for <br /> funding is intense and the County can ill afford any <br /> negative points from HUD. <br /> <br /> <br />
