Page 2 <br />· ' ' July 27, 1984 <br /> <br /> Please notify this office by September 12~ 1984 in writing, with <br /> appropriate documentation, as to whether or not the unserved county <br /> plans to join your agency in order to participate in the Community <br /> Services Block Grant Program during Federal Fiscal Year 1985 and the <br /> · Community Action Partnership Program, <br /> <br /> Appropriate documentation should reflect that the governing boards <br /> of the community action agency and the County Commissioners have elected <br /> to expand the area served by the existing community action agency. When <br /> these decisaons have been made, provide this Division with the following <br /> information: <br /> <br /> 1. A letter from the County Commissioners stating their desire to <br /> be served by your agency and to participate in the Community <br /> Services Block Grant and Community Action Partnership pro- <br /> grams; and a letter from your Board stating your intention to <br /> serve the county and a timetable to plan for the new county to <br /> be a part of the community action agency in Federal Fiscal <br /> Year 1985; or <br /> <br /> 2. A letter from the Board of County Commissioners indicating <br /> they do not wish to join your agency at this time to parti- <br /> cipate in the Community Services Block Grant and Community <br /> Action Partnership programs. <br /> <br /> It is crucial for both program planning and administrative purposes <br /> that this Division and your agency know well in advance what counties <br /> will participate in these anti-poverty programs. This information is <br /> needed in order to determine and to notify your agency how funds will be <br /> allocated in the forthcoming fiscal year It is my understanding that <br /> the Boards of County Commissioners usually meet on the first Monday of <br /> each month. Therefore, it is essential that you contact the Board of <br /> Commissioners immediately. <br /> <br /> Should your agency and the county elect to incorporate an unserved <br /> county into the existing community action agency, your agency will have <br /> to meet applicable requirements established by federal and state legisla- <br /> tion and the North Carolina Administrative Code, including the <br /> requirements related to your board structure, public hearings, and <br /> Community Anti-Poverty Plans. For example, with the incorporation of <br /> an unserved county, your board will have to be broadened to iuclude <br /> representation from the new county. (See Section 675(c)(3) of the <br /> Omnibus Budget Reconciliation Act of 1981, as amended, Rule .0109 of the <br /> Subchapter 16(C) of the North Carolina Administrative Code, and Section <br /> 113-28.26 of the Coauaunity Action Partnership Act.) The expansion of <br /> your board may result in changes in your agency's articles of incorpora- <br /> tion and by-laws. The Division recommends that your agency consult its <br /> attorney on this and other related matters. <br /> <br /> <br />
