§ 130-9.5. Nursing home advisory committees, la) State_recur of Pu:-pose. -- It is the purtmse of the Genera! Assemh!y that commuuity advisory committees work [o maintain the spirit of the Nursing Hmne Bill Of Rights ~Cbap~er 130. Article 30) within the nurshig homes in this State. It ~s the ihrther pm'pose of the Genera[ Assembly that the committees promote comm~ni[y hlvolve~lent a~d cooperation with oaFsiBg homes alld al! ini.egration of these homes iu[o a system of care for the e!der]y. Ibl Establishment amt Appointment of Committees. ~ A community advisory committee shall be established in each county which has a nm'sin~ home. shall serve all the homes in tbe county, aud shall work with each home for the best interests of the persoas reskfing iu each borne, in a county which has one, two, or three nursing homes, the committee shall have five m~mbers. In a county with lbur or more nursing homes, the committee shall have one additional member tbr each nursing home in excess of three. In each county with four or more nursing homes, the committee shall estab- lish a subcommixtee of {~ve members from the committee iBr each nursing home in the county. Each member must serve on at least one sobcommittee. ~]ach committee shall be appointed by the board ofcounty commissioners. Of the mmnbers, a mi~iotity ~not less tlmn one third, but as close to one tbird as unssible) must be chosen l?om among persons noniinated by a majority of the ~hief administrators of nursing bmnes in the count)'. If ~he nursieg hmne administrators fail to make a nomiuation within 45 days aher written aotifiea- [ion has been sent to them by the bomxi ofcoumy commissioners requesting a npmination, such appointmeuts may be made by the ooard of county commis- moners without nominations. Cc) Terms of Office. ~, Each committee tnember shall serve an iakiai term of one year. Any person reappointed to a second or suh~e~uem term in the same coun[y shall serve a t hree-vear term. Persons who were originally nominees of nursing home chief adm[~fisu'ators, m' who were appointed by the board of county commissioners when [he nursing home administrators ~ailed to make nominaLions may not be reappointed withou, the consem of a majority of the nursing home chief administrators wi thin the count v. If the nursing home chief administrators fail to approve or reject the reappdin[ment within ,t5 days of being reques[ed by the board of county commissioners, the commissiotmrs may reappoint the member if they so choose.
