RESOLUTION DECLARING AN INTENT <br /> TO ABANDON AND CLOSE TWO PORTIONS <br /> OF SIXTY (60) FOOT ROAD SHOWN <br /> ON PLAT RECORDED IN PLAT BOOK <br /> 15, PAGE 41, CABARRUS COUNTY PUBLIC <br /> REGISTRY OFF TOM QUERY ROAD IN <br /> CABARRUS COUNTY, NORTH CAROLINA <br /> <br /> WHEREAS, DMS MAY COMPANY, a North Carolina corporation, has <br />petitioned the County of Cabarrus to close and abandon two <br />certain portions of a sixty (60) foot road shown on a plat of The <br />Kerr Industries property recorded in Plat Book 15, Page 41, <br />Cabarrus County Public Registry ("the road"), a copy of which <br />petition is available for inspection in the Office of the Clerk <br />to the Board of Commissioners, Room 120, Cabarrus County <br />Courthouse, Concord, North Carolina, and which two portions of <br />the road are shown on survey prepared by Concord Engineering & <br />Surveying, Inc., dated May i5, 1982, and which two portions of <br />the road are more particularly described in Addendum A attached <br />hereto and made a part hereof. <br /> <br /> WHEREAS, the procedure for closing streets and public alleys <br />as outlined in Chapter 153A, Section 241, of the General Statutes <br />of North Carolina, requires that Board of Commissioners adopt a <br />Resolution declaring its intent to close the street or public <br />alley and calling a public hearing on the question. The Statute <br />further requires that the ResolUtion be published once a week for <br />four (4) successive weeks prior to the hearing, a copy of the <br />Resolution be sent by registered or certified mail to all owners <br />of propertY adjoining the street or public alley as shown on the <br />County Tax Records and a notice of the closing and public hearing <br />be prominently posted in at least two (2) places along said <br />street or public alley: <br /> <br /> WHEREAS, the Board of Commissioners desires to grant the <br />Petition: <br /> <br /> NOW, THEREFORE, BE IT RESOLVED AND DECLARED by the Board of <br />Commissioners of the County of Cabarrus at its regularly <br />scheduled session of __ ~rch 21 , 198__~, that it <br />intends to close those two certain portions of a sixty (60) foot <br />road shown on plat recorded in Plat Book 15, Page 41, Cabarrus <br />County Public Registry, which two parcels of the road are shown <br />on survey prepared by Concord Engineering & Surveying, Inc., <br />dated May 15, 1982, a copy of which is available for inspection <br />in the office of the Clerk of the Board of Commissioners in Room <br />120 of the Csbarrus County Courthouse, at Concord, North <br />Carolina, and which portions of the road are more particularly <br />described in Addendum A attached hereto and made a part hereof, <br />and the Board of Commissioners hereby calls a public hearing on <br /> <br /> <br />
