NORTII CAROLINA <br /> <br />CABARRUS COUNTY <br /> <br /> TIIIS AGREEMENT, made and entered into this 16th day of May 1983, by <br /> <br />and between CABARRU$ COUNTY, party.~>f the first part (hereinafter referred <br />to as "COUNTY"), and BOARD OF LIGIIT AND WATER COMHISSIONERS OF THE CITY OF <br />CONCORD, party of the second part (hereinafter referred to as "BOARD"); <br /> <br /> W I TNE S S E TH : - <br /> <br /> That whereas, County is in the process of building wate~ supply l[ues <br />outside of the corporate limits of the City of Concord, and whereas it <br />desires to purchase water from the Board on a wholesale ba~ls and the Board <br />ia w~ll~ng to sell water to ~be Connty upon the terms and c~onditlons hereinafte <br />set forth; <br /> <br /> NOW, THEREFORE. in consideration of the premises and ~he agreements <br />here~n made, the parties do hereby agree as follows: <br /> <br /> 1. Tbe Board will sell to the County water at tbe sauie universal rate <br />established by the Board for its customers inside the CitylLimit~, which <br />rate the Board may increase or decrease during the term or,this agreemeot <br />aa may be necessitated by debt service, capital outlays, maintenance and <br />operation costs. <br /> <br /> 2. Water will be delivered by tbe Board to the Couety at selected <br />polnta~ mutually agreed upon by both parties hereto, and will be metered <br />£hrough a master meter co..ection at each of those points. The County will <br />pay for and install said meters of a type approved by the Board. <br /> <br /> 3. The Board will supply water to the County to meet its needs in an <br />amouet up to one million gallons per day, which obligation amount may not <br />be accumulated, subject however to the obligation of the Board to provide <br />water to its other customers~ both within and without the corporate limits <br />of the City of Concord, and with the understanding and agreemeet that the <br />Board shall not be liable in damages for the failure to furnish s sufficient <br />supply of water or the amount contracted for, or the quality of same, <br />arising from aa act of God or conditions beyoad control of the Board, and <br />tile County will [ndemnify and save harmless the Board from any claim of the <br />customers of the County arising from any such failure. <br /> <br /> <br />
