STATE OF NORTH CAROLINA <br /> <br /> COUNTY OF CABARRUS <br /> <br /> AGREEmeNT <br /> <br /> THIS AGREEMENT, entered into this __ day of <br /> <br />1983, by and between the To~v~ of Harrisburg, a municipal corpora- <br />tion, State of North Carolina (the "To~n"), party of the first <br />part; and the County of Cabarrus, State of North Carolina (the <br />"County"), party of the second part; <br /> <br /> W!TNE SSETH: <br /> <br /> ~^~EREAS, the parties hereto have agreed to enter into a <br />projecn to construct an interceptor pipeline to carry the flow <br />of sewage from Harrisburg to the Rocky River Regional Wastewater <br />Treatment Plant. <br /> <br /> WHEREAS, the To~ of Harrisburg has agreed to serve as the <br />contracting agency for the construcnion of the interceptor pipe- <br />line, acquisition of real property, rights of way and easements. <br /> <br /> NOW, THEREFORE, for and'in consideration of the premises, <br />the mutual promises, and covenants herein contained, and the <br />mutual benefits flowing to the parties hereunder, the parties <br />hereby agree and contract as follows: <br /> <br /> !. The Town of Harrisburg will serve as contracting agency <br />for the project and will employ engineers to design the project <br />and prepare plans and specifications for its construction. <br /> <br /> 2. The To~n will acquire all property, e~sements and rights <br />of way and other property interests as may be necessary for the <br />construction and maintenance of the in6erceptor pipeline and take <br />title to such properties in the name of Cabarrus County. <br /> <br /> <br />
