G. The ho]der of any residential franchise is entitled to <br /> bid upon any commercial, industrial or besiness account <br /> ill Cabarrus County. In addition, the County-Commissioners <br /> may grant on a case-by-case basis, non-exclusive franchises <br /> for tile collection of solid waste from commercial, industrial <br /> and business establishments throughout the County. See <br /> Section VII. <br /> <br />H. 1, Any person with a complaint against tile collectors <br /> concerning fees, solid waste collection methods, <br /> or other matters, may appear before the Health <br /> Director or tile County Commissioners and present <br /> his complaint in writing, , <br /> <br /> 2. Tile Health Director shall investigate ali. charges <br /> involving this ordinance or performance thereunder. <br /> <br />I. A list'of all'franchises defining the areas concerl]ed and <br /> enumerating tile holders of each franchise shall be main- <br /> tained in tile office of the Health Director of Cabarrus <br /> County. <br /> <br />J. This ordinance shall not affect pending litigation. <br /> <br />SECTION X - FEES <br /> <br /> The County Commissioners shall establish and regulate all <br />fees charged for tile collection and transportation of solid waste. <br />A copy of the fee schedule shall be filed in the office of the <br />Health Directorlof Cabarrus County. <br /> <br />SECTIO~ XI - PERFORMANCE BOND <br /> <br /> Each holder of a franchise shall provide and maintain a <br />performance bond or cash deposits in amounts determined by the <br />County Commissioners and in any event, in a minimum amount of <br />$2,000.00 and filed at the Health Director~ Office of Cabarrus <br />County, conditioned on the faithful performance of their duties <br />hereunder, which ~ond shall be subject to forfeiture in the event <br />of the revocation or suspension of the franchise after tile hearings <br />provided for by Section XIII of this Ordinance or in the event of <br />the termination of service to a franchise area by the voluntary <br />act of the holder of tile franchise. <br /> <br />SECTION XII - COMPETITIVE BIDDING <br /> <br /> The County Commissioners shall have the right to request <br />bids and the payment of license fees to the County for tile award <br />of franchises upon the expiration, termination or abandonment of <br />any franchise currently in effect or hereafter granted. Such <br />bidding shall be upon such terms and conditions deemed by the <br />commissioners to be in the best interest of tile pub]ic health and <br />welfare. <br /> <br /> ! <br /> <br /> <br />
