· · · · · · · · - <br /> <br /> 2, No person shall abandon a franchise without at <br /> least 30 days prior written notice thereof to <br /> the County Com~missioners and the Health Director. <br /> <br /> C. The franchise areas described in Exhibit A, which is <br /> attached hereto and made a part hereof, being the fran- <br /> chise areas presengly assigned to the persons named <br /> therein, are hereby deemed to be effective, unless <br /> terminated as provided herein. New or renewal franchises <br /> shall be awarded for terms not exceeding five (5) years. <br /> <br /> D. Termiuation and Suspension - All or any portion of a <br /> franchise may be terminated or suspended for any of the <br /> following reasons by the procedures provided in Article <br /> XIII hereof: <br /> <br /> 1. Termination of the Health Department solid <br /> waste management permit; <br /> <br /> 2. Non-compliance with or violation of the maximum <br /> fee schedule promulgated by the County Commissioners; <br /> <br /> 3. The attempted transfer of a franchise without <br /> prior written approval of the County Commissioners; <br /> <br /> 4. Collection of refuse or the solicitation of customers <br /> outside the territorial area awarded to the holder <br /> of tbe franchise; <br /> <br /> 5. Failure to comply with the terms and provisions <br /> of this ordinauce or regulations promulgated by <br /> tile County Commissioners or tbe Health Department <br /> hereunder; <br /> <br /> 6. Failure to render .regular service at least once <br /> during each seven-day collection period. <br /> <br /> 7. Failure to comply with any directives issued by <br /> the Health Director or the County Commissioners <br /> after notice of hearing when such directive involves <br /> performance, customer service or compliance with <br /> these'regulations <br /> <br /> E. Any conflict over the grant of a franchise and disagree- <br /> ments over franchise territory shall be determined by <br /> the county Commissioners. <br /> <br /> F. Any person operating under a franchise shall present to <br /> each customer in advance of any agreement with that <br /> customer a schedule of his fees. All solid waste shall <br /> be removed from the customer's premises no less frequently <br /> than once per week, provided the customer is no more than <br /> ten (10) days in arrears in payment thereof. <br /> <br /> -7- <br /> <br /> <br />
