James <br /> contracted with an unlicensed individual who had some carpentry <br /> experience. Apparently attracted by a very iow price, l,~rs. James <br /> nor the laborer secured a building permit or made anv inquiry as <br /> to the requirements of the cons~ruc~ron er placement-of ~he <br /> tended building. <br /> <br /> As a review of'the criteria for hardship tile snarl finds tile <br /> following: <br /> <br /> 1. No special conditions or circumstances exist which are pecu- <br /> liar to the land, structure or building involved which are <br /> non applicable to others in the neighborhood In face. the <br /> [opography, lot sizes and general conditions are similar <br /> those others in the neighborhood. There is eothing peculiar <br /> as concerns this lot or building alone that does non exist <br /> on neighboring properties in the general area. <br /> <br />2. A literal interpretation of the provision of this ordinance <br /> wonld not deprive the applicant of rights commonly enjoyed <br /> by other properties in the neighborhood. The applicant sited <br /> a situation at 1012 Desoto Avenue. This has no bearing on <br /> the case. <br /> <br />3. The granting of a special use permi[ will confer upon this <br /> applicant special priveliges which are not extended to e~hers <br /> in the neighborhood or the remainer of tile County. <br /> <br />4. The special conditions and circuustances do result from action <br /> of the applicant. This applicant precipi~ted the entire in- <br /> cident as there was no violation prior to the commencement of <br /> the additional automobile storage area. <br /> <br />Therefore, as the applicant, in the opinion of the staff, has failed <br />to meet not only one but all of the requirements of the hardship <br />criteria required by the ordinance, tile request shonld be denied. <br /> <br /> <br />
