SUBJECT: - Men~al Heal~h; Area Me~'~al Health, Mental <br /> Retardation and Substance Abuse Authorities; <br /> Proper Nam~ of Local Mental Health Unit <br /> <br />.~QUESTED BY: Sarah T. ?4orrOW, M.D., <br /> Secretary <br /> Department of H~man Resources <br /> <br /> QUESTIONS: - (1) In' order to comply with Chapter 358 of <br /> 1979 Session Laws, is it mandatory ~or an area <br /> · ' -' ' 'authority to change ihs name to A'rea 'Men~al' <br /> Realth, Mental Retardation and Substance Abuse <br /> ' Authority? <br /> '(2) If the'answer %o the first '~'uestion is yes, <br /> what is the penalty, if any, for an area authority. <br /> %:;hich does not comply? <br /> <br /> CONCLUSIONS: (1) Yes. <br /> (2) It would appear ~hat allocations of state <br /> and ~ederal appropriated funds can only be made <br /> to area mental health,.mental. retardation and <br /> substance abuse authorities. <br /> This office has previously issued'an Opinion that, under then <br /> existing statutes, the name of an'area mental health program must <br /> actually include hbe language "area mental health program." See <br /> N.C.A.G. 233 (1975). Since the date of that opinion, the statutes <br />- dealing with %his subject have b~en revised in both the 1977 and the <br /> 1979 sessions of %he General Assembly. In ~heir present form, the <br /> pertinent statutes are contained in Article 2F of Chapter 122. <br /> <br /> <br />
