North Carolina (hereinafter <br /> referred to as the "Board") and ?BILIP MORRIS INCORPORATED, a <br /> Virginia corporation (hereinafter ~eferred to as "Industry"); <br /> <br /> STATEMENT OF PU~OSE <br /> <br /> ~ndustry is the owner of certain land fronting along the <br />westerly side of Union Cemetery Road in Cabarrus County, North <br />Carolina. Industry is in the process of constructing a large <br />manufacturing plant and other related storage and trainin§ <br />facilities on such land, In order for Industry to fully utilize <br />its land for the intended purposes it must obtain access to <br />adequate sewage disposal facilities. The County is T-he owner of. <br />and the Board is the operator of. a certain existing sewer line <br />located near Industry's property, and this sewer line has the <br />capacity to serve Industry,s needs. Industry has requested the <br />County and the Board to provide its required sewer facilities. <br />The County and the Board are cognizant of the benefits to be <br />derive~ 6~ them and the citizens of Cubarrus County and the ~ity <br />Of Concord from the construction of Industry's facilities and are <br />willing to provide the facil ities as reguested by Industry upon <br />the terms and conditions set forth in this Agreement. <br /> <br /> T~EREFORE, in consideration of the ~bove-stated premises and <br /> <br />and sufficiency of which are hereby acknowledged, the parties <br />hereby agree as follows: <br /> <br /> <br />
