AN ORDINANCE OF THE COUNTY OF CABARRUS, <br /> NORTH CAROLIMA ESTABLISHING MINIMb%.~ LOT <br /> SIZES FOR RESIDENTIAL USES <br /> <br /> WHEREAS, The General Statutes of North Carolina, Section <br /> 153-9 (55), provide for the adoption of ordinances to regulate <br /> and prevent conditions which are a detriment to the public good; <br /> and <br /> <br /> WHEREAS, the Board of County Commissioners of Cabarrus <br /> County find it necessary to avail itself of these powers for <br /> the purposes set forth in the enabling legislation; <br /> <br /> NOW THEREFORE, be it ordained by the Board of County <br /> Commissioners of the County of Cabarrus, North Carolina, as <br /> follows: <br /> <br /> Section I. Jurisdiction <br /> <br /> On and after August 13, 1979, these reRulations shall apply <br /> to all residential type development within Cabarrus County, North <br /> Carolina, and outside the jurisdiction of any municipality. <br /> <br /> Section II. Definitions <br /> <br /> For the purposes of this ordinance, the following shall <br /> apply: <br /> <br /> 1. Residential Unit - dwelling: Any ~uilding used <br /> exclusively for human habitation. <br /> <br /> A. Single-family dwelling: A detached building used <br /> exclusively as a place of residenae for one family. <br /> <br /> B. Dual-family dwelling: A building used as a place <br /> of residence for two.(2) families occupying separate dwelling <br /> units. <br /> <br /> 2. Multi-residential Unit - A grouping of 3 or more <br />residential units that are contiguous by their construction either <br />horizontally or vertically. <br /> <br /> A. Multi-family dwelling unit (apartment): A combination <br /> of three (3) or more residential units under the same o%~ership <br /> for the purpose of renting or leasing. <br /> <br /> B. Condominium: Single unit residential ownership in a <br /> multi-unit structure with common open space. <br /> <br /> C, Multi-family - Individual ownership (Townhouses, <br /> Rowhouse, Patio Home etc.): Single 'residential ownership <br /> in a multi-unit structure with the lot lines defined. <br /> <br /> 3. Lot - A parcel or tract of land described by metes and <br />bounds in a legal instrument recorded or filed in the Cabarrus <br /> <br /> <br />
