Chandler, Jr./Director of Planning <br /> <br />SUBJECT: Fairway Drive; Foxlaire Subdivision <br /> <br />DATE: November 5, 1979 <br /> <br />At the time Mr. Morris came into the office we had several in- <br />depth discussions on his proposed subdivision, Foxlaire, prior <br />to the submission of a preliminary plat. The preliminary plat of <br />Foxlaire subdivision; sections 1-4 was approved on March 8, 1979 <br />at the Planning Board meeting but as the final improvements, eg; <br />street paving, etc., still had to be completed, the final plat <br />was not approved until September 12, 1979. The plat was recorded <br />in the Register of Deeds office on September 14, 1979 with the <br />name of Belshire Drive, approved by the Planning Department, being <br />the principal street running through the subdivision. <br /> <br />During pre-planning disucssions of the preliminary plat, ~. Morris <br />expressed the desire to name the street in question, Fairway Drive. <br />After being informed that the name of Fairway was deceptively similar <br />to other roads in the County, eg; Fairveiw Street, Fairbluff Road, <br />and that these older established roads would take precedence over <br />any new road name he selected the name, Belshire. (Department of <br />Transportation District Engineer, b~. T. L. Patterson, indicated <br />that these roads were on the system since July 1, 1931 at the time <br />the state took over maintenance of roads in the County). <br /> <br />As the 1973 General Statutes #153A-240, specifically dis-allows <br />deceptively similar street names, the name Fairway was determined <br />to be similar to other official names in the County and therefore <br />was required to be ineligible for assignment for a new street. <br /> <br />As Mr. Morris had never filed a recorded plat, nor referred to the <br />street in any deed as Fairway Dive, the name Fairway Drive can only <br />be ass~ned to be a name arbitrarily chosen with no official sanction. <br /> <br /> <br />
