<br /> Your Petitioners, the Cabarrus County Board of Education, t he Rowan County Board of
<br />Education, the Kannapolis City Board of Education, and others,respectifully show to the °card:

<br />1. That M. azie Avenue is a Street running No~th and South and beginning at Bzantley ~oad in
<br />Cabarrus ~ounty, North Carolina, and ending at East llth Street inHowan County,North Carolina;
<br />that these Petitioners are land owners on and adjoining Marie Avenue.
<br />2. That the Cabarrus County Board of Education, the Rowan County Board of Education and t~e Kann-
<br />apolis City Board of Education are owners in fee simple and are in t he possession of certain
<br />tracts of land adjoining andabutting the East side and the West side of Marie Avenue, ~dthin the
<br />portion of Marie Avenue designated by the intersecton of-Marie Avenue and Venus Drive on the SouSh
<br />in Number 4 Township inCabarrus County, North Carolina, ahd by the intersection of Marie Avenue
<br />and Jackson Street on theNorth in China Grove Township in~owan County, North Carolina; that the
<br />portion of Marie Avenue refermed to isaSh°wn inaPart on Mapp numberj2 of Archer Park, Book of maps
<br />page 321 of the aowan County Regist_~y, nd in p rt on the lat of ackson Park,s.map book,3 page
<br />23, in the Cabarrus County Registry.
<br />3. That ~ithin the above referred to portion of Marie Avenue on the East side and West side,
<br />adjoining and abutting Marie. Avenue, all property is owned by the Cabar~us County Board of
<br />Education, the '~owan County °card of Education, and the Kannapolis City Board of Education with ~
<br /> the exception of a small lot of land owned by Sadie H Funderburk and B.A. Balt~d, of Number l~
<br />Township,Cabarrus ~ounty, North Carolina, which persons have joined in the execution of this petit~ ~n.
<br />h. That Marie Avenue has been previously accepted by~e State Highway and Public Works
<br />:~ommission of N.C. for maintenance and notice of the presentation and hearing of this Petition
<br />has been given by registered letter to the N.C. State Highway and P'ubl~ Works Commission; that
<br />the portionof Marie Avenue petitioned to b e closed consists of one block.
<br />5. That the propertyowned by the Cabarrus Uounty Ooard of Education andaowan County Board of
<br />Education, . adjoining and abutting the portion of Marie Avenue referred to, isdes~gnated as
<br />Jackson Park Elementary School proprty, and is used by said °card of Education for School purposes
<br />including play grounds and recreational facilities; that there is a portion of the property of
<br />the respective Boards of Education and the Kannapoiis City B~d of Education on the East side
<br />of Ma tie Avenue and adjoining and abutting said Avenue which is not used at the present time for
<br />play grounds nor recreational facilities due to the fact that school children:~, of Jackson
<br />ParkElementary School cannot with safety cross t bsportion of~arie Avenue referred to; that it is
<br />the desire of the respective Boards of ~gducation to use the property owned hy the respective
<br />Board of Education on the East side of the portion of MarieAvenue referred to for play grounds afl
<br />other recreational facilities; t~at in order for this to be done the general welfare and safety
<br />of the students of the school necessitate the closing of the portion of Marie Avenue referred
<br />to.
<br />6. That these ~etitioners submit that the closing of the portion of Marie Avenue ~eferred to is
<br />not contrary jto the public interest and that no individual owning property in the vicinity of s~id
<br />street or in the subdivision in which it is located will thereby be deprived of reasonable
<br />~sans of ingress and egress to his property; that for the proper administration c~the duties,
<br />~ obligations, and ~esponsibilities of the respective Boards of Education it is submitted that
<br />such action by this Board in closing the portion of Marie Avenue referred to wJ_ll contribute
<br />materially to the safety of the hRildren attending Jackson Park Elementary Schooland will enhance
<br />the recreation facilities at their disposal; that it is further submitted that such closing will
<br />not be ~etrimental to the proper enjoyment of their property by persons who own property on Marie
<br />Avenue nor in the surrounding area.
<br />7. That it is submitted that all persons who have executed this petition are land owners on
<br />Marie Avenue and it is Rurther submitted that land owners not executing this petition have been
<br />notified of the presentation and hearing of this petition hy registeredmail.
<br />8. That the respective Board of Education caused the following notices to be published once
<br />iper week for four weeks in the Kannapolis Indepdnet, a newspaper published in Cabarrus ounty,
<br />North Carolina, and The Salisbury Evening Post, a newspaper published in RowanCoonty, North
<br />Carolina:
