401 <br /> <br /> On Motion by P.Eznest Stallings, seconded by W.Erank McCray the vote being unanimous <br /> the following Agreement covering policement or other law enforcement off~ers under <br />~ old-age and survivors insurance provisions of Title II of the Federal SocialSecurity Act, was <br /> approved. <br /> North Carolina <br /> Cabar rus County <br /> THIS AGREEMENT made an~ entered into on this the 3 day of June, 1957 by Cabarrus ~ounty <br /> Oommissione~s, hereinafter referred to as the Political Subdivision, t he party of the f~ st part, <br /> and the Secretary of,.,the Board of.Trustees pf the Teachers' and State Employees' Retirement <br /> Sustem, hereinafter referred'to asthe State Agency, the party of the second part: <br /> <br /> ,'~ WITNESSETH <br /> <br /> That the ~olitical Subdivision, by virtue of the power and authori~ty conferred upon it <br /> by its charger, by Chapter 160 of the General Statutes of North Carolina, as amended, or by virtue <br /> of Chapter 153 of the General Statutes of North Carolina, as amended, and by virtue of Article 2 <br /> of Chapter 135 of the General Statutes of North Carolina, as amended , forthe purpose of extendin <br /> to the policemen or other law enforcement officers of,politiCal subdivisions the basic pzotectiom <br /> afforded by the Old-Age and Survivors Insurance System embodied in the Social Security Act, has <br /> agreed with the State Agency fo~ the purpose of establishing the plan as follows: <br />~'~ 1. It is agreed that the State Agency is hereby authorized to include this Political <br /> Subdivision with respect to policemen oz other law enforcement officers, who participate in the <br /> Law Enforcement Officers' Benefit and Retirement Fund and in the Cabazz~s County Emergency Reserve <br /> Fun~d, in any original Agrement, or any modification thereof, entered into between the State of <br /> North Carolina and the Secretary of Health, Education and Welfare of the United States pursuant <br /> to Section 218 of the Social SecuzityA ct and Article 2 of Chapter 135 of the General Statutes, <br /> as amended, and any other North Carolina enabling legislation. <br /> 2. It is agreed between this Political Subdivision and the State' AGency that the <br /> Agreement of Janualy, 16, 1956, is hereby amended to include these services effective January l, <br /> 1957. <br /> IN WITNESS ~REOF, the Political Subdivision, by virtue of its authority as provided by <br /> la~ and by virtue of a ~esolution or o~der duly passed by the governing authority of said <br /> Political Subdivision, a certified copy of which resolution oz order is here~ attached, has <br /> caused these presents to be executed in its hehal~ by its Chairman or presiding Office~, whose <br /> signature appears below, and attested by its Clerk or Secretary, whose signatume appears below: <br /> and further: <br /> IN WITNESS ~EHEOF, the State Agency has caused this Agreement to be signed by the Secretary <br /> of th Teachers' and State Employees' Retirement System as authorized by law and whose signature <br /> appeare herein below attached to this Agreement or plan. <br /> <br /> J.
