<br />(b) That all of the territory! described in said petition is located in the County of Cabarrus,
<br />and thatno municipal corporation or any part c~ the territory of a municipal corporation is
<br />included in said territory.
<br />
<br />(c) ~hat said petition was duly signed by 164 freeholders residing within t he proposes sanitary
<br />district, that there are 286 freeholders within the said propssed sanitary district, and that the
<br />number of resident freeholders who signed said petition is more than 51% of the freeholders within
<br />said proposes sanitary district.
<br />
<br />(d) That said petition requests the Board of Commissioners for the County of Cabarzus to take all
<br />necessarya ction required by Article 12 of Chapter 130 of the General Statutes of North Carolina
<br />for the creation of a sanitary district and sets forth the boundaries of the propesed sanitary
<br />district and the objects it is proposed to accomplish.
<br />
<br />(e) That following receipt of said petition the Board of Commissioner, through its Chairman,
<br />notified the State Board of ~eA&th of the receipt of said petition, and requested that a representat ire
<br />~f the State Board of Health hold a joint public hearing wit h the County Commissioners of Cabarru~
<br />County concerning the creation of the proposed sanitary distri~t~.
<br />
<br />(f) That the State Health Director and the Chairman of the Board of Commissioners have named Tues¢ ~y
<br />August 26, 1958, at h o'clock, p. M. in the Educational Building of the Southside Baptist Ghurch,
<br />located within the proposed sanitary district, as the time and place at which said public
<br />hearing should be held.
<br />
<br />(g) That the Chairman of the Board of Commissioners gave prior notice of such hearing by
<br />posting a notice at the Courthouse door of the County on July 28, 1958 and also by publication of
<br />such notice in The Concord Tribune, a newspaper publiched in Cabarrus County, on July 28 and August
<br />~, 1958, with directions to such newspape~ for the further publication of such notice on August ll
<br />18, and 25, 1958.

<br /> Section 2. That the action of the Chairman in posting the following notice of public
<br />hearing on the creation of a sanitary district at the Coumthouse door on July 28, 1958 and in
<br />authorizing the publication of such notice in The Concord Tribune Inc. on July 28 and August 4, ll
<br />18 and 25, 1958 be and the sameis hereby ratified and confirmed:
