477 The Board of Cabarrus County Commissioners met at a special meeting on ~eptember 22, 1958 at 10 o'clock at the Courthouse with the following members present: C~matiaaienezs~:n~.~moot Lyles, P. Eznest Stallings and~Guy Isenhouz Absent: Chairman, W.Frank McCray and L.Bowman Barrier. The following resolution was introduced and passed : Commissionex~-~ P.Ernest Stallings introduced the following resolution which was read: RESOLUTION APPROVING, RATIFYING AND CONFIRMING A RESOLUTION PA~SED BY THE BOARD OF COmmISSION,S FOR THE 00UNTY ~F CABARRU~ ENTITLED : "RESOLUTION CONCERNING CREATION C~ A SANITARY DIS- TRICT IN CABAREUS COUNTY~' BE IT RESOLVED by the Board of Commissioners for the County of ~'a~arrus that a resolution passed by the Board of Commissioners forths County of Cabarrus after a public hearing held jointly with a representative of the NorthC~z~tiaa State Board of Health on August 26, 1958 mbich resolution is in the following wo~ds and figures, be and the same is herebyapproved, ratifie~ and confirmed: "RESOLUTION CONC~BNING CREATION (F A SANITARY WH~EAS, a petition proposing the creation of a sanitary district in Cabarrus County was filed with the ~oard of Commissioners on July 7, 1958, which petition is set forth in the minutes of the August h, 1958 meeting of said Board, and is as follows: PETITION FOR CREATION OF SANITARY DISTRICT ~e, the undersigned_f~eeholders within t he boundaries of the territory described below respectfully petition the ~oard of Commissioners for the County of Cabarrus, North Carolina, to take all necessary action required by Article 12 of Chapter 130 of the General Otatutes of North Oarolina~3r the creation of a sanitary district comprising such territory, the objects p~oposed to be accomplished by the creation of such district beingthe acquisition, construction, maintenance and operation of a water supplya nd distribution system, a sewerage system, sewage disposalor treatment plant, providing adequate firs protection facil, ities, and such other utilitie~ as may be necessary for the preservation and promotion cg the public healt~raad sanitary welfare within the district. All of the territory proposed to he included in such sanitary district is located in Cabarrus ~ounty, NorthCarolLua, and the boundaries of such territory are as follows: Beginning at a point in the western boundary of the Main Line of the Southern Railroad opposite the centerline of Short Street adjoining the South aide of the Franklin Mill property in South Concord, thence following said cenrerline ef~hort Street No~th 8~ dsgrees West, 1500 feet; thence North 68 degrees 30 minutes West, 620 fe~t mo~e or less toa point halfway between Jackson Street ad the Old Charlotte Highway; thence halfway betwe~en said streets, South 47 degrees ~est 475 feet tothe center cf ~ockwell Road; thence South 55 degrees East 250 feet more or less to a Point 100 feet east of Jackson Street; thence parallel to Jacksm~ Street in two courses South 38 ~egrees West, 560 feet and South 5 degrees West, 840 fe~t more or less to the center of Sunset Creek; th ncc following said Sunset Creek downstream, following the various couzses and meanderings thereof, and continuing to the western boundary of the -~outhern RailZoad; thence following said western bounaary of the railroad to the point of beginning.'
