<br /> Also present: Marshall Staton representing the North Carolina State Board of Health.

<br /> fit the hour of h:OO o'clock P M., the acting Chairman announced, that , pursuant to a
<br />notice2duly posted and published, this was the date and hour fixed by the Board of Commissioners
<br />and the State Health Director of the North Carolina S~te Board of Health for the joint public
<br />hearing upon a petttiun filed with the Board of Commissioners for the County of Cabarrus on June
<br />6, 1960, proposing the creation of a sanitary district in Cabarrus County.
<br />
<br /> The acting Chairman announced that the Board of Commissioners and the representative of the
<br /> ;tare Board of Health would immediately hear any and all freeholders and o~zr interested persons
<br /> ~oncerning the creation of the proposed sanitary district.
<br />
<br /> The acting Chairman introduced Mr. Marshall Staton, representative of the State o~rd of Healt].
<br /> Mr.Staton explained the petition and read the legal!description of the territory included in the
<br /> )roposed district. He then asked if anyone desired to speak against the petition. No one spoke
<br /> ~gatnst the petition. He then asked for those in favoe of the petition. No one Spoke in favor of
<br /> the petition but those present indicated that they were in favor of it/ There were 28 persons
<br /> )resent.
<br />
<br /> No freeholder or other interested person appeared, either in person or by attorney, to protest
<br /> ~gainst the creation of the proposed sanitary district, and the Clerk announced that no protest
<br /> in writing, signed by any freeholder or other interested person, had been presented.
<br />
<br /> Thereupon Commissioner W.Guy Isenhour introduced the following resolution which was read:

<br /> RESOLUTION CONCERNING CREATION OF A
<br /> SANITARY DISTRICT IN CABARRUS COUNTY
<br />
<br /> WHEREAS, a petition proposing the creation of a sanitary district in Cabarrus Connty was filed
<br /> dth the Board of Commissioners on June 6, 1960 which petition is set forth in the minutes of the
<br /> June 6, 1960 meeting of said Board, and is as follows:

<br /> PETITION FOR CREATION OF SANITARY DISTRICT
<br />
<br /> We, the undersigned resident freeholders within the boundaries of the territory described
<br /> ~low respectfully petition the Board of Commissioners for the County of Cabarrus, North Carolina
<br /> ~o take all necessary action required hy Article 12 of Chapter 130 of the General Statutes of North
<br /> ~arolina for the creation of a sanitary district comprising such territory, the objects proposed
<br /> ~o he accomplished hy the creation of~uch district being the acquisition, construction, maintenanc~
<br /> md operation of a water supply and distribution system, a sewerage system, sewage disposal or
<br /> ~reatment plant, providing adequate fire protection facilities, and such other utilities as may he
<br /> ~ecessary for the preservation and promotion of the public health and sanitary welfare within the
<br /> iistrict.

<br /> All of the territory proposed to be included in such sani~rF district is located in Cabarrus
<br /> ~ounty, North Carolina, and the boundaries of ~suuch territory are as follows:

<br /> BEGINNING AT a Black Jack Oak, in the north lineof Lot No. 31, BlockA of Rockland, corner of
<br /> iabarrus County Home Property and Annie K Turner Property, a nd being designated as "Control Corner"
<br /> )n plats of Rockland, No. 11 Township, recor4ed in Pl~t Book 8 page 76, and plat book 9 page 30,
<br /> in the office of the Register of Deeds for eabarrus County, North Carolina; thence, with the line
<br /> )f Cabarrus County Home Property, the followtn§ four'courses: North 14 degrees 32 minutes East
<br /> ~6 feet to a stone; thence South 70 degrees 45 minutes East, 646.60 feet to a stone ih the
<br /> ;estern Right of Way line of Rockland Circle; thence north 40 degrees 30 minutes East, 348 feet
<br /> ~o a s tone; thence North 15 degrees East, 113.40 feet to a point in the southern Right of way
