STATE OF NORTH CAROLINA PROJECT NO. <br /> <br /> aAmma~ , COUNTY PARCEL NO. <br /> <br /> AGREE?lENT FOR ENTRY <br /> and <br /> WAIVER OF INTEREST <br /> <br /> THIS AGREEI~iENT made this the ~g ! day of ~/~¢~-~ , 192~_, by <br />and between the North Carolina state 'Highway vCOmmisSion (hereinafter <br />called the Commission) and~,~om~%~A~o£~mmAm.~.~. <br /> <br /> (hereinafBer called the owners); <br /> W I T N E S S E T H: <br /> <br /> THAT WHEREAS, the Commission desires to enter certain lands of <br />the owners located in ~. ~ &~l Township, ~.~ County, <br />described as follows: ~.~ ~xm~*~ ~f ~ ~,.~ .~ ~ ~.~ <br />~ ~e land of ~, C. ~ oa ~ ~outh, ~' ~,baaw~ Cc~$, A~A~lt~at <br /> <br />for the construction of State Highway Project 8.1GXg~ , <br /> <br /> WHEREAS, the Commission is authorized by G. S. 1~6-118 to enter <br />into this agreement without filing the pleadings as set forth in <br />G. S. 1~6-103. <br /> <br /> WHEREAS, the owners and the Commission have been unable to agree <br />on the amount the owners should receive as compensation for all <br />damages resulting from the construction of Project $~1~ . <br /> <br /> WHEREAS, the owners desire to continue negotiations and that the <br />Commission not institute condemnation proceedings at this time; <br /> <br /> NOW, THEREFORE, the owners do hereby agree and consent that no <br />interest shall accrue and do hereby waive all interest, on any sum <br />which the parties may hereafter agree to as settlement of the claim <br />or on any sum which may be awarded the owners in a proceeding to <br />determine just compensation as provided in Article 9, Chapter 136 of <br />the General Statutes of North Carolina. <br /> <br /> The undersigned owners do hereby consent and agree that the <br />Commission may enter upon the above-described lands for carrying on <br />the work and construction of Pro~ect $~61~ in accordance with the <br />plans and specifications on file in its office in Raleigk, North <br />Carolina, and that the Commission shall have the same rights for <br />carrying on the work and construction of the project as it would have <br />by filing the pleadings required in G. S. 136-103. <br /> <br /> IT IS FURTHER AGREED THAT, in the event the parties hereto have <br />not settled the owners' claim for just compensation upon the complet- <br />ion of the said highway project, either the Co~nission or the owners <br />within Twelve (12) months after the project is completed, may proceed <br />to a determination of just compensation as provided in Article 9, <br />Chapter 136 of the General Statutes of North Carolina. <br /> <br /> The parties hereto agree that the right of entry granted shall <br />not be deemed a trespass on the owners' property and shall not impair <br />the owners' right to make claim against the Commission for just com- <br />pensation arising out of the taking and construction of the project. <br /> <br /> This agreement executed in duplicate the day and year above <br />written.
