PROPOSED <br /> <br /> A RESOLUTION OF Tt~ COUNTY OF CABARRUS, NORTH CAROLINA <br /> ESTABLISHING A COUNTY PLANNING BOARD <br /> <br /> Wt~REAS, the General Statutes of North Carolina, Section <br /> 153-9 (40), provides for the establishment and operation of <br /> County planning boards; and, <br /> <br /> WHEREAS, the General Statutes of North Carolina, Chapter <br /> 153, Article 20B enables the County of Cabarrus to avail <br /> itself of the powers for the zoning of Cabarrus County through <br /> the appointment of a county planning board; and <br /> <br /> WHEREAS, the Board of County Commissioners of Cabarrus <br /> County, North Carolina finds it necessary to create and establi., <br /> such a planning board for the purpose as set forth in said <br /> Enabling Legislation; <br /> <br /> NOW, THEREFORE, be it resolved by the Board of County <br /> Commissioners of the County of Cabarrus, North Carolina, as <br /> follows: <br /> <br /> SECTION I. That a Cabarrus County Planning Board be <br /> established as follows: <br /> <br /> "Section I, Establishment and Jurisdiction." <br /> <br /> There is hereby established a board to be known <br /> as the Cabarrus County Planning Board whose <br /> jurisdiction shall include the area within the <br /> boundaries of Cabarrus Co.unty. <br /> <br /> "Section 2. Composition and Term of Office." <br /> <br /> The Cabarrus County Board of Commissioners <br /> shall appoint five (5) members who shall be <br /> residents of Cabarrus County. All appointed <br /> members shall serve a term for three years <br /> except for the initial appointment when one <br /> member shall be appointed for a one year term, <br /> two members shall be appointed for a two year <br /> term, and two members shall be appointed for <br /> a three year term. Vacancies shall be filled <br /> for the unexpired portions of the terms in the <br /> same manner as the initial appointment. <br /> <br /> "Section 3. Powers and Duties." <br /> <br /> It shall be the duty of the Cabarrus Planning <br /> Board to prepare plans and to coordinate the <br />JOHN$ON.
