i. Any other costs, whether direct or indirect, clearly attributable <br /> to the request for law enforcement assistance borne or to be borne by <br /> the sending party. <br /> <br /> 10. In lieu of computing the detailed costs to it of furnishing law enforce- <br />ment assistance, a sending party may, where it is more convenient to do so, deter- <br />mine the reasonable value of the assistance rendered and submit an invoice for this <br />amount. Such invoice may also be based in part upon a calculatiQn of costs and in <br />part upon a determination of reasonable value of the assistance rendered. In any <br />event, the invoice submitted should contain a sufficient itemization of amounts <br />charged so that the general basis for any particular charge is reflected. <br /> <br /> Il. Notwithstanding any other provision of this agreement, the requesting <br />party shall not be liable to the sending party for any costs borne by it on account <br />of acts of the employees or agents of the sending party of the kind set out in this <br />paragraph. To the extent that liability attaches at all to a political subdivision <br />of the State, the sending party shall be solely liable in the event of litigation <br />or other costs arising with respect to: (1) failure of equipment or other material <br />furnished that resulted solely from negligence by employees or agents'of the send- <br />ing party prior to the time of the request for law enforcement assistance: (2) wilful <br />misuse of equipment or other material of the sending party by employees or agents <br />of the sending party, when such wilful conduct was in no way sanctioned or commanded <br />by any person in or apparently in authority acting on behalf of the requesting party; <br />(3) wilful and malicious misconduct of employees or agents of the sending party that <br />was in no way sanctioned or commanded by any person in or apparently in authority <br />acting on behalf of the requesting party; (4) acts wtlfully done by employees or <br />agents of the sending party in defiance of orders of authorized officials of the <br />requesting party. <br /> <br /> 12. The requesting party agcees to pay the sums falling due under this agree- <br />ment within the current fiscal year if sufficient funds are available. If payment <br />cannot be made within the current fiscal year without unduly disrupting the financial <br />operations of the requesting party, the requesting party agrees to pay the sums fall- <br />ing due under this agreement in the next succeeding fiscal year, and to levy suffi- <br />cient taxes for this purpose. <br /> <br /> 13. Law enforcement officers and other personnel furnished a requesting <br />party under this agreement shall remain on the payroll of the sending party and <br />shall also retain in performing their duties in the jurisdiction of the requesting <br />party (and in traveling from the sending party to the requesting party) all juris- <br />diction, authority, rights, privileges, immunities, and benefits, including cover- <br />age under workmen's compensation laws, which they have in the sending.party. Law <br />enforcement officers of the sending party shall have the full aUthority to make <br />arrests and to execute criminal process'in the Jurisdiction of the requesting <br />party that is granted in G.S. 160-20.2 (c).- <br /> <br /> 14. 'This agreement may be cancelled at any time after a resolution to that <br /> effect bY the governing body of either party to this agreement has been duly adopted <br /> upon the mailing of a written notice of that resolution to the chief elected official <br /> of the other party. <br /> <br /> 15. This agreement shall be in full force and effect from and after its <br /> execution by the appropriate officials on behalf of the governing bodies of both <br /> parties, its ratification by resolutions of the respective governing bodies, and <br /> its recordation in the minutes of both parties. <br /> <br /> <br />
