full costs are determined. In computing costs, the sending party may include: <br /> <br /> a. The compensation paid to auxiliary police officers or other substitute <br /> personnel called to duty in the sending party on account of furnishing law en- <br /> -forcement assistance. The compensation paid shall be deemed to be on <br /> account of the furnishing of law enforcement assistance if it would not <br /> otherwise have been paid, and includes compensation paid or payable to <br /> 'substitute officers or other personnel after the emergency has passed <br /> if necessitated on account of giving compensatory time off to those who <br /> were sent to the requesting party. <br /> <br /> b. The costs of calling auxiliary police or other substitute personnel <br /> .to duty, and any special costs of maintaining them on duty, if they would <br /> not have been so called to duty except for the furnishing of law enforce- <br /> ~ent assistance to the requesting party. <br /> <br /> c. The reasonable rental value of substantial items of equipment or <br /> other material furnished to the requesting party, when the amortization <br /> costs df such items of equipment or material are not included in computing <br /> the costs of services elsewhere submitted on invoice to the requesting <br /> party. The rental may be fixed on a time or mileage basis, or such other <br /> basis as may be appropriate to the particular equipment or material in <br /> question and the use to which it was subjected~ Where rental is figured <br /> on an overall time basis, the time period shall run during the time the <br /> equipment or material was away from its place of storage or duty. <br /> <br /> d. The cost of maintaining, replacing, or repairing any uniforms, supplies, <br /> equipment, or other material borne or to be borne by the sending party on <br /> account of furnishing 'law enforcement assistance under this agreement. <br /> <br /> e. Such costs of transporting, maintaining, housing, and feeding law <br /> enforcement officers and other personnel of the sending party as were <br /> borne by the sending party and were attributable to the furnishing of <br /> law enforcement assistance under this agreement. <br /> <br /> f. Such costs of transporting, maintaining, and storing equipment, <br /> supplies, and other material furnished the requesting party as were borne <br /> by the sending party--to the extent that such costs were attributable to <br /> the request for law enforcement assistance under this agreement. <br /> <br /> g. The special costs of any benefits, penalties, damages, or indemnities <br /> paid or payable by the sending party to its employees or others on account <br /> of the furnishing of law enforcement assistance under this agreement. <br /> This includes such increases or estimated future increases in costs of <br /> insurance premiums as may be attributable to the furnishing of law en- <br /> forcement assistance. Where such benefits, penalties, damages, indemnities, <br /> or other costs detailed in this agreement are payable by an insurer or <br /> other indemnitor, or are reimburseable to the sending party by such <br /> insurer or indemnitor (other than the requesting party), the requesting <br /> party shall not be liable except for net costs, interest payments, or <br /> other Special costs actually borne by the sending party. <br /> <br /> h. The net costs of any litigation, including court costs, damage awards, <br /> and legal fees, to which the sending party is subjected on account of its <br /> furnishing law enforcement assistance under this agreement. <br /> <br /> <br />
