AN ORDINANCE OF THE COUNTY OF CABARRUS <br /> NORTH CAROLINA ESTABLISHING MINIMUM LOT <br /> SIZES FOR RESIDENTIAL USES <br /> <br /> WHEREAS, The General Statutes of North Carolina, Section 153-9 (55), <br />provide for the adoption of ordinances to regulate and prevent conditions which are <br />a detriment to the public good; and <br /> <br /> WHEREAS, the Board of County Commissioners of Cabarrus County <br />find it necessary to avail itself of these powers for the purposes set forth in the <br />enabling legislation; <br /> <br /> NOW, THEREFORE, be it orda~ed by the Board of County Commis- <br />sioners of the County of Cabarrus, North Carolina, as follows: <br />Section I: Jurisdiction <br /> <br /> On and after June 7~ 1971, these regulations shall apply to all residen- <br />tial-type development within Cabarrus County, North Carolina, and outside the <br />jurisdiction of any municipality. <br />Section II: Definitions <br /> <br /> For the purposes of this ordinance the fol, lowing shall apply: <br /> <br /> 1. Residential Unit - One structure or dwelling mintained, con- <br />structed, or intended to be used for living or sleeping purposes by one family. <br /> <br />2. Multi-residential Unit - A grouping of two or more residential <br />units that are contiguous by their construction either horizontally or vertically. <br /> <br /> 3. Lot - A parcel or tract of land described by metes and bounds <br /> <br />in a legal instrument recorded or filed in the Cabarrus County Courthouse, or <br />shown on a plat recorded in the Cabarrus County Registry. <br /> <br /> 4. Space - An area within a lot clearly defined by c6rners, fences <br /> <br />or other visual markings and leased or rented by the owner of the lot. <br /> <br /> 5. Residential-type Development - Any lot or space on which there is <br />located any residential unit or multi-residential unit. <br /> <br /> 6. Water - Potable water furnished to lots or spaces from a municipal, <br />sanitary, or community system approved by the Health Department. <br /> <br /> <br />
