3. Where septic tanks with drain fields are to be used to dispose <br /> <br />of the sewage the length of nitrification lines for a residential unit shall not <br />be less than the size determined to be adequate by the Cabarrus County Health <br />Department after investigation of soil conditions, proposed individual disposal <br />system, and depth of ground water. <br /> <br /> 4. Every lot or space for residential-type development located on <br /> <br />a public water-shed as defined by the Cabarrus County Board of Health shall <br />have sufficient area to meet County Health Standards and State Board of Health <br />requirements. <br /> <br />Section V: Enforcement <br /> <br /> The Cabarrus County Building Inspector or his authorized agent <br /> <br />shall be carged with the responsibility of enforcing this ordinance in accordance <br />with the General Statutes 153 (356-363) and with issuing the permits as required <br />by this ordinance. Decisions of the Building Inspector may be appealed to the <br />Board of County Commissioners, decisions of the Board of Cabarrus County <br />Commissioners may be appealed to the Superior Court of the County of Cabarrus, <br />North Carolina. Upon recommendation of the Building Inspector the Board of <br />Commissioners may institute appropriate legal action to enjoin the violation of <br />this ordinance. <br /> <br />Section VI. Procedure for Special Use Permits <br /> <br /> The Board of Commissioners may allow the issuance of Special Use <br />Permits or exceptions for specific cases which vary from the requirements of this <br />ordinance, provided that such variations will not have the effect of nullifying the <br />intent and purpose of these regulations. The Board shall not grant a Special Use <br />Permit unless and until: <br /> <br /> 1. A written application for a Special Use Permit is submitted indi- <br />cating the section of this ordinance under which a variance is sought. <br /> <br /> 2. A public hearing is held. Notice of such public hearing shall be <br />posted on the property for which a Special Use Permit is sought and in a local <br /> <br /> <br />
