In order to qualify for a Special Use Permit, the applicant must <br />satisfy the Board of Commissioners that he meetslhe requirements of either <br />A, B, or C below. <br /> <br /> A. Extreme personal hardship exists. Such hardship <br /> <br /> shall involve the need to care for elderly parents or the depen- <br /> dents of the family occupying the principal residential unit. <br /> Reasons amounting to an extreme personal hardship shall be <br /> incompatibility, contagious disease, illness, or lack of ade- <br /> quate space within the principal residential unit. <br /> <br /> These permits are issued on a temporary annual basis, <br /> renewable as long as hardship exists by presenting evidence <br /> of its continuance to the Board. <br /> <br /> B. Physical Hardship. <br /> <br /> 1. Special conditions and circumstances exist <br /> which are peculiar to the land, structure, or building <br /> involved and which are not applicable to other lands, <br /> structures, or buildings in the same neighborhood. <br /> <br /> 2. A literal interpretation of the provisions of <br /> this ordinance would deprive the applicant of rights <br /> commonly enjoyed by other properties in the same <br /> neighborhood. <br /> <br /> 3. That granting the Special Use Permit requested <br /> will not confer on the applicant any special privilege <br /> that is denied by this ordinance to other lands, structures, <br /> or buildings in the same neighborhood. <br /> <br /> C. Planned Unit Development. <br /> <br /> In the case of a unified or group residential project such as <br /> multi-family dwellings where measures have been taken to: insure <br /> adequate safeguards from fire, panic, and other dangers; provide <br /> adequate light and air; prevent the overcrowding of land; avoid undue <br /> concentration of population; and facilitate the adequate provision of <br /> <br /> <br />
