2. The party of the first part shall pay to the party of the second <br /> part the sum of Four Thousand Two Hundred Fifty-Nine Dollars and Eight <br /> Cents ($4, 259.08) per month for his services in operating and maintaining <br /> said landfill as set out in Exhibit A altached to the cottracl of January 12, <br /> <br /> 1972, said monthly payments to be made on the 1st day of the month for the <br /> and shall begin March 1, 1973 <br /> prior mont~; provided, that the landfill operator shall submit a statement <br /> <br /> for each monthly payment first to the Health Director of the Cabarrus <br /> County Board of Health for his approval and said payment shall not be made <br /> by said Cabarrus County until approval is certified by the Health Director, <br /> who has the responsibility of supervising the sanitary landfill operation. <br /> <br /> 3. Contemporaneously with the execution of this agreement the <br /> party of the second part will furnish a performance bond in the amount of <br /> Four Thousand Dollars ($4, 000.00), whiCh bond shall be conditioned upon <br /> the satisfactory operation of said landfill by the party of the second part <br /> and his compliance with the terms of this agreement and which bond shall <br /> be forfeited in the event of the brach of this agreement in the following <br /> manner: The Health Director of Cabarrus County shall give the party of <br /> the second part written notice of non-compliance of the party of the second <br /> part with this agreement with the further notice thai the party of the <br /> second part shall have five (5) days from the date of said notice to correct <br /> said non-compliance and if said party of the second part fails to comply <br /> in the manner set out in said notice to the satisfaction of the Health Directo~ <br /> of Cabarrus County, said bord shall be forfeited. <br /> <br /> 4.
