294

Bobby Batson, Public Relations Director at Charlotte Motor Speedway, stated that according
to past records at the Speedway, he would estimate that 30 people might need hospital care. He
stated that the promoters were only estimating attendance at between 90,000 and 100,000 people.
He, also, stated that the restroom facilities at the Charlotte Motor Speedway would be open for
those who came early and that the Speedway was built to handle a large number of people and felt
as if there would be enough concession and sanitary facilities to care for the people.

The following resolution was introduced by Commissioner McClary, seconded by Commissioner
Hammett, and duly adopted by the unanimous vote of all Commissioners present:

WHEREAS, an action was instituted in the United States District Court for the
Middle District of North Carolina on or about the 3rd day of July,1974, entitled
"Textile Workers Union of America, AFL-CIO-CLC, and Pauline Freeman, Plaintiffs, v.
Cannon Mills, Inc., Robert Ketchie, Darrell Cunningham, Lee Polk, J. B. Roberts, and
Fred Wilson, Defendants"; and

WHEREAS, Defendant J. B. Roberts is Sheriff, and Defendants Robert Ketchie,
Darrell Cunningham, and Lee Polk are Deputy Sheriffs and employees of Cabarrus
County; and

WHEREAS, the complaint in said action as to Defendants Robert Ketchie, Darrell
Cunningham, Lee Polk and J. B. Roberts alleged matters which purportedly arose out
of their employment by Cabarrus County;

BE IT RESOLVED that the Board of Commissioners of Cabarrus County assume the
responsibility for the defense of said action as to Defendants Ketchie, Cunningham,
Polk, and Roberts.

BE IT FURTHER RESOLVED that County Attorney John R. Boger, Jr., and his firm

of Williams, Willeford, Boger & Grady be retained by the Board to appear as attorneys
to defend said action in their behalf.

Having no further business, meeting adjourned.

Clerk ~o the Board
